A military M38 does not have a tailgate; a CJ3 will.
A military M38A1 has the batteries in an box with a big hinged external lid in front of the passenger's knees. The CJ5 has them under the hood.
A military M38A1 has the gas tank under the driver's seat. The CJ5 has a separate filler neck on the body side - after the first couple of years.
A military M38A1 will have a 24v slave cable socket on the right front sidewall.

does anyone here own one? would love to see one in person. #1 favorite for me.
